Website Terms of Use

These Website Terms of Use (“Terms”) govern access to and use of tanspullman.com and its public content and features (collectively, the “Site”). The Site is operated for Tan's Chinese Restaurant (“Tan's,” “we,” “us,” or “our”).
These Terms concern the Site. They do not eliminate duties applying to food sold or service provided by the restaurant and do not waive any right or responsibility that applicable law does not permit to be waived.
1. Acceptance and permitted access
By accessing or using the Site, you acknowledge these Terms. If you do not agree, do not use the Site.
Tan's grants visitors a limited, revocable, nonexclusive right to access the public Site for lawful personal and informational purposes. No ownership interest or broader license is transferred.
2. Informational Site; no online transaction
The Site provides general information about Tan's, including its menu, hours, location, and contact information. It does not presently accept online orders, reservations, payments, customer accounts, or contractual commitments.
Viewing a menu item or price does not reserve an item, establish availability, complete a purchase, or guarantee that the restaurant can fulfill a particular request. A restaurant transaction occurs separately through the method accepted by Tan's at that time.
4. Food allergies and dietary restrictions
Food is prepared in a shared kitchen, and allergen cross-contact may occur. Menu descriptions are summaries, not recipes or complete ingredient or allergen statements. An ingredient, supplier, preparation method, surface, utensil, or other kitchen condition may change.
Before ordering, tell restaurant staff about every food allergy or dietary restriction and ask about the current ingredients and preparation of the specific item. Do not rely solely on the Site when deciding whether a menu item is appropriate for an allergy or dietary need.
Restaurant staff may describe current ingredients and reasonable preparation precautions, but a shared kitchen means allergen cross-contact cannot be eliminated. Tan's cannot guarantee that any item is free from a particular allergen or suitable for a medical diet. Information on the Site is not medical or nutritional advice.
5. Accuracy and changes
Tan's works to keep the Site useful and current but does not promise that every item of information will always be complete, current, or error-free. Information may be updated without advance notice.
If Site information conflicts with information provided directly by authorized restaurant staff concerning current operations, ingredients, availability, or price, ask staff to clarify before ordering or purchasing.
6. Accessibility and privacy notices
The Site’s Accessibility Statement describes its accessibility target and assistance process. The Privacy Policy describes the limited information practices associated with the Site.
Those notices do not waive a legal right or obligation and are not incorporated as warranties beyond their stated terms.
7. External links and services
The Site may link to Google Maps, OpenStreetMap, or another external service for convenience. Tan's does not control and does not endorse every statement, feature, availability representation, security practice, accessibility practice, or privacy practice of an external service.
Use of an external service is governed by that service’s own terms and policies. A link does not create a partnership, agency relationship, sponsorship, or warranty.
8. Prohibited conduct
You may not use the Site to violate applicable law or another person’s rights; attempt unauthorized access to the Site, its infrastructure, or another system; introduce malicious code or interfere with Site availability or security; circumvent a technical or security measure; misrepresent an affiliation with Tan's; use Tan's branding or Site content to deceive another person; or copy or exploit protected Site content for unauthorized commercial use.
Ordinary browser access, search-engine indexing, accessibility technology, and reasonable personal printing are not prohibited.
9. Intellectual property
The Site’s branding, logos, original text, graphics, arrangement, and design are protected by applicable intellectual-property law and may be owned by Tan's or used with permission.
You may view and print Site information for personal, noncommercial use. Except as permitted by law, you may not reproduce, modify, distribute, sell, impersonate, or commercially exploit protected Site content without authorization.
10. Site availability and warranty disclaimer
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis. Tan's does not warrant that access will be uninterrupted, completely secure, or error-free, or that every item of Site information will remain current at all times.
This disclaimer applies to the informational Site. It does not disclaim food-safety obligations, obligations concerning goods or services actually sold, disability-access obligations, liability for fraud or willful misconduct, or consumer rights and other duties that applicable law does not permit Tan's to exclude.
11. Limitation concerning Site use
To the fullest extent permitted by law, Tan's will not be liable for indirect, incidental, special, or consequential loss arising solely from access to, reliance on, or inability to use the informational Site or an external website linked from it.
This limitation does not apply to physical injury; Tan's’s own negligence, gross negligence, fraud, or willful misconduct; a food-safety duty; a statutory duty; or any liability that applicable law does not permit to be limited.
12. Responsibility for unlawful misuse
Where these Terms form an enforceable agreement and applicable law permits, a person who deliberately or unlawfully misuses the Site is responsible for losses and third-party claims caused by that misuse.
This provision does not make a visitor responsible for Tan's’s own negligence, wrongdoing, breach of an independent duty, or liability that applicable law does not permit to be shifted.
13. Enforcement
Tan's may restrict access, preserve relevant records, or seek an available legal remedy when it reasonably believes that a person has unlawfully interfered with the Site, threatened its security, infringed protected rights, or used it to deceive or harm another person.
A delay in enforcing a provision does not authorize the conduct or create a continuing waiver.
14. Governing law and forum
Where these Terms form an enforceable agreement, they are governed by Washington law, without regard to conflict-of-law principles, except where nonwaivable law requires otherwise.
A dispute concerning only the Site or these Terms must be brought in a court of competent jurisdiction in Whitman County, Washington, or, where federal jurisdiction exists, the United States District Court for the Eastern District of Washington, except to the extent applicable law does not permit that forum requirement.
15. Changes to these Terms
Tan's may revise these Terms when the Site, restaurant practices, providers, or applicable requirements change. The effective date at the top identifies the current version. Revised Terms apply prospectively when posted, subject to any notice or assent required by law.
16. Severability and interpretation
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent or severed if necessary, and the remaining provisions will continue to apply.
Headings are for readability. Nothing in these Terms will be interpreted to waive a right or impose an obligation that applicable law does not permit to be waived or imposed.
